Espaliera Terms of Service

These Terms of Service cover your use of the site at https://espaliera.co together with the grove-share memberships, seasonal boxes and grower notes we deliver through it.

By browsing https://espaliera.co you accept these terms in full and agree to follow the laws that apply where you live. If any part of them does not work for you, please stop using the site and the services attached to it.

We may revise these terms from time to time — when a new variety enters the rotation, when a delivery partner changes, or when the law asks us to. Revisions are published on this page and take effect the day they appear here.

Limitations of use

When you use this site you agree, for yourself and for anyone acting on your behalf, that you will not:

• adapt, decompile or reverse engineer any material or software published on this site;
• strip harvest credits, cultivar attributions or other proprietary notices from anything you download;
• hand the material to another party or mirror it on a server we do not operate;
• use the site or its connected services in a way that degrades them for other members;
• publish or transmit anything through the site that is harassing, deceptive or unlawful;
• harvest member details, delivery addresses or pricing data by automated means.

Membership and deliveries

A grove share renews each season until you pause or cancel it from your account. We bill on the first working day of the season and confirm the charge by email before any fruit is picked. Cancellations made at least nine days before the pick window take effect immediately; anything later applies to the following season.

Fruit is a living product. Peel colour, size and sugar vary between pickings, and a late frost can move a delivery window by a week or more. Where a variety fails entirely we substitute a comparable one from the same block, or credit the share back to your account at your choice.

Grower notes and other material

The grove journals, pruning guides, illustrations and photography on this site remain ours or our contributors'. You may read, print and share them for your own non-commercial use, with the credit line left intact. Republishing them, feeding them to a training corpus or reselling them requires written permission first.

Liability

The site and its material are provided as they stand. We do not promise that every page is free of error, that the site will be reachable at all hours, or that a stated pick date will hold. To the extent the law allows, we are not liable for indirect or consequential loss arising from your use of the site — and in any case our liability is capped at the amount you paid us in the twelve months before the claim.

Governing law

These terms are governed by the laws of the state in which our packhouse is registered, and any dispute is heard by the courts of that state. Where a clause is found unenforceable, the rest of these terms continue to apply.
